Many Complex Issues

Gambling and the Law: Court Rules Tribal Casino is Merely a Casino | www.eog.com

Tribal sovereign nation status is a Federally approved law which has been challenged and has been upheld in the courts.  The labor issues are new and still will have a number of challenges ahead for the Native American Tribes.  However, this issue has also surfaced a number of other complicated issues that now involve organized labor and the unionization of many employees working in Native American casinos.  This is also being challenged in he courts.  However, where there is smoke, there is usually fire. Many issues related to labor have now surfaced and if nothing else will serve as a good reminder that everyone needs to be more sensitive to the feelings and sentiments of their employees whether they work in a Native American Casino or a publicly held corporate casino in Las Vegas or Atlantic City.  This case will probably continue for many years before final resolution.

Gambling and the Law: Court Rules Tribal Casino is Merely a Casino | www.eog.com

The effect of taking certain aspects of sovereignty away from the tribes could set off a very large legal battle. How will this affect the bottom line for these casinos? Is there a compromise in the offing and if so when?

Caesars Windsor impresses patrons | www.canada.com

Only time will tell whether the expenditure of $430 million was a wise decision for Caesars Windsor. If the decision to make this expenditure were being made today the current state of the financial markets would have probably mad4 the decisions for them. Casinos in North American are facing unprecedented challenges due to numerous economic forces. Caesars Windsor's proximity to Detroit with the downturn in the auto industry can only magnify these challenges. The weak U.S. dollar also does not help in attracting the American market.

Can this “new” facility attract enough incremental play and visitation to justify the cost?  With high gas prices, increase border security, an overall weak economy and a weak dollar, how many Americans will make the trip on a regular basis?

Caesars Brand Strong Enough to Win

July 8, 2008

Caesars Windsor impresses patrons | www.canada.com

Since the merger in 2005 and Harrahs going private probably the smartest and most significant change to come in the organization is the branding of Harrah's to Caesars Entertainment. Although Harrah's itself is a strong brand as was Horseshoe which is also owned by Harrah's, the names have never commanded the high roller and old Vegas style that the Caesars brand has carried for years. There has always been a significant corporate cultural difference in the Caesars brand that has been successful in very diverse jurisdictions that continues to appeal to the regular gaming customer. Caesars Windsor can attract the needed incremental play and beyond in this economy on the brand if there is some investment into the service experience expectations of their guests and the property staff from executive to front line consistently buy into the Caesars culture. If Harrah's adopts Caesars culture into it's brand I believe you could see significant performance gains throughout the organization.

Good News for Penn Gaming -- in the Long Run

July 7, 2008

Penn National Gaming Cancels Its Sale to Private Equity Firms | www.nytimes.com

The buyers' willingness to pay a $225 million kill fee and an interest free loan of $1.25 billion shows that things are as bad as they seem -- not for gaming, but for banks.  Penn Gaming gets an enormous influx of cash, making it even more attractive for future buyouts.  It also shows what good lawyering can do.
