Summary

Gen-Probe filed a patent infringement lawsuit against BD this week alleging that sales of BD's Viper with XTR technology and ProbeTec molecular diagnostic systems infringe several Gen-Probe patents.  The two companies compete against one another in the large molecular diagnostics test segment for sexually transmitted diseases that include chlamydia and gonorrhea.

Analysis

Gen-Probe's recent patent infringement lawsuit against BD illustrates the intense market share battle being waged in the high growth, high margin molecular diagnostics space.  Currently, the majority of novel molecular diagnostic assays are used to test for infectious diseases, including sexually transmitted infections such as chlamydia and gonorrhea.  Sophisticated molecular diagnostic test systems are also used to safeguard the nations blood supply and test for infectious diseases such as H1N1 (swine flu) and Hospital Acquired Infections (HAIs).  Other smaller, yet fast growing molecular diagnostic segments include those for cancer testing and pharmacogenomics.
