In general Tribes cannot be sued for any reason within or outside the borders of their reservation. If the decision to make this expenditure were being made today the current state of the financial markets would have probably mad4 the decisions for them. Casinos in North American are facing unprecedented challenges due to numerous economic forces. Caesars Windsor's proximity to Detroit with the downturn in the auto industry can only magnify these challenges.The weak U.S. dollar also does not help in attracting the American market.

There is nothing like a home court advantage. A federally recognized Indian tribe operating a casino on its own reservation has a tremendous advantage over other potential gaming operators. As a sovereign nation, and depending on their individual agreement with the State, they are exempt from State and Federal taxes on their operation. Their sovereign status can free them from labor laws, building and zoning regulations and civil authority by State courts. Their gaming operation can be regulated by the Tribe itself without outside scrutiny, they may be exempt from health and safety rules and regulations, even prohibitions on smoking imposed by the State. None of these potential advantages would be enjoyed by a commercial gaming competitor and the Tribe would not have these advantages outside its reservation. I would stay home too.

There exists many potential problems for non Native Americans working as employees of Federally recognized Native American Tribes. First, many Tribes exercise Native preference in hiring and promotion of employees. Non Indians therefore can face an up hill battle from the start. Second, current case law restricts State and Federal government oversight over employment and labor laws on reservations. The reservations are considered for these purposes as sovereign and employees recourse in cases where they believe they are unfairly treated must rely on tribal courts. The story as written is one being repeated nationwide. The National Labor Relations Board is recently beginning to allow the right of employees to organize and join unions, Tribes however are fighting this tooth and nail. Example the Mashantucket Pequot Tribe, owners of the Foxwoods Casino in Connecticut.
